Terms of Service

These Terms of Service ("Terms") govern your access to and use of InvitelyApp's website and services for creating, sending, and managing event invitations and RSVPs (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old to use the Service. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. Using the Service

You agree to use the Service only for lawful purposes. You agree not to:

  • Send spam, unsolicited bulk messages, or invitations to people who have not agreed to hear from you.
  • Upload content that is unlawful, infringing, harmful, or violates the rights of others.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems.
  • Use the Service to collect or misuse other people's personal information.

3. Your content

You retain ownership of the content you create, upload, or send through the Service, including event details, images, and guest lists ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate and provide the Service, such as delivering invitations and displaying RSVP pages.

You are responsible for Your Content and for ensuring you have the rights and permissions needed to use it and to contact the guests you add.

4. Guest communications

InvitelyApp sends event invitations, RSVP reminders, and messages you compose to the guests on your list. Adding a guest is never conditional on agreeing to messaging: every part of the Service works whether or not you confirm permission to text, and a phone guest added without it is simply never texted — they are marked "not texted" on your guest list and reach the event by email or their own RSVP link.

Before we text a phone guest on an event, you (the host) confirm that you have that person's permission, using a checkbox that is unchecked by default. Anything beyond that single invitation — reminders and messages you send — additionally requires the guest's own opt-in, which they give themselves on their RSVP page. We keep a permanent record of each confirmation, including your account, the guest's contact information, and the time it was given.

You are solely responsible for your communications with guests and for having the permission you represent above. We may set reasonable limits on message volume to protect the Service and its users. Message frequency varies by event. Message and data rates may apply to text and WhatsApp messages.

5. Opting out of guest messages

A guest who receives a text message or WhatsApp message through the Service may opt out of future messages at any time by replying STOP. Once a guest opts out, we will not send further text or WhatsApp messages to that phone number through the Service, across any event or host, unless the guest opts back in by replying START. This is separate from a host's ability to remove a guest from a specific event.

Replying HELP to any message returns our program name and support contact. You can also reach us at support@invitelyapp.com. Message frequency varies. Message and data rates may apply.

Carriers are not liable for any delayed or undelivered messages.

6. Plans, payments, and refunds

Some features require a paid plan. Prices and plan details are described on our pricing page and may change over time. Fees are charged as described at the point of purchase. Except where required by law, payments are non-refundable.

7. Intellectual property

The Service, including its software, design, templates, and branding, is owned by InvitelyApp and protected by intellectual property laws. Except for Your Content, we grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm or legal liability. Upon termination, your right to use the Service ends, though certain provisions survive.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, InvitelyApp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
