These Terms of Service ("Terms") govern your access to and use of InvitelyApp's website and services for creating, sending, and managing event invitations and RSVPs (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
You agree to use the Service only for lawful purposes. You agree not to:
You retain ownership of the content you create, upload, or send through the Service, including event details, images, and guest lists ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate and provide the Service, such as delivering invitations and displaying RSVP pages.
You are responsible for Your Content and for ensuring you have the rights and permissions needed to use it and to contact the guests you add.
InvitelyApp sends event invitations, RSVP reminders, and messages you compose to the guests on your list. Adding a guest is never conditional on agreeing to messaging: every part of the Service works whether or not you confirm permission to text, and a phone guest added without it is simply never texted — they are marked "not texted" on your guest list and reach the event by email or their own RSVP link.
Before we text a phone guest on an event, you (the host) confirm that you have that person's permission, using a checkbox that is unchecked by default. Anything beyond that single invitation — reminders and messages you send — additionally requires the guest's own opt-in, which they give themselves on their RSVP page. We keep a permanent record of each confirmation, including your account, the guest's contact information, and the time it was given.
You are solely responsible for your communications with guests and for having the permission you represent above. We may set reasonable limits on message volume to protect the Service and its users. Message frequency varies by event. Message and data rates may apply to text and WhatsApp messages.
A guest who receives a text message or WhatsApp message through the Service may opt out of future messages at any time by replying STOP. Once a guest opts out, we will not send further text or WhatsApp messages to that phone number through the Service, across any event or host, unless the guest opts back in by replying START. This is separate from a host's ability to remove a guest from a specific event.
Replying HELP to any message returns our program name and support contact. You can also reach us at support@invitelyapp.com. Message frequency varies. Message and data rates may apply.
Carriers are not liable for any delayed or undelivered messages.
Every event starts on the Free plan, which includes all current features up to a set number of guests per event. The current limits and prices are on our pricing page and may change over time; a change never removes guests already on an event.
Guests you add yourself and guests who join through your shareable link count toward the same limit. A guest you remove after they have been sent an invitation, or after they have replied, still counts toward it, so that removing and re-adding people cannot be used to go past the limit.
Plus is a one-time purchase for a single event that raises that event's guest limit, as described on our pricing page at the time you buy. It is not a subscription: nothing renews and you will not be charged again. Plus stays with the event it was bought for and cannot be moved to another event or account.
Plus is sold through Link, a service of Stripe, which acts as the seller (merchant of record) for the purchase. Link processes your payment, works out and collects any sales tax, VAT, or GST (included in the price shown), sends your receipt, and handles payment questions. The charge appears on your statement as "LINK.COM* INVITELYAPP". Link's own terms and privacy policy, shown at checkout, also apply to the payment.
Plus is applied to your event once the payment is confirmed to us by Stripe, usually within seconds. If we suspend or remove an event for breaking these Terms, Plus on that event ends with it and is not refunded.
If Plus isn't right for you, contact us at support@invitelyapp.com within 14 days of purchase for a full refund. After that, refunds are at our discretion, except where the law requires otherwise.
When a purchase is refunded, or the payment is disputed with your bank, the event goes back to the Free plan. Guests already on the list stay invited, but no more can be added beyond the Free limit.
From time to time we may offer promotion codes for Plus. Unless a code says otherwise:
The Service, including its software, design, templates, and branding, is owned by InvitelyApp and protected by intellectual property laws. Except for Your Content, we grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm or legal liability. Upon termination, your right to use the Service ends, though certain provisions survive.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, InvitelyApp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
